Your Excellency,
I would like, at the outset, to express the Frente POLISARIO’s sincere congratulations on your assumption of the Presidency of the Security Council for this month.
It is with a great sense of urgency and grave concern that I write to you, on instructions from my Authorities, to draw your attention and that of the Members of the Security Council to the alarming situation in the Territories of Western Sahara under Morocco’s illegal occupation where Moroccan occupying authorities are intensifying their repressive and terrorising actions against Sahrawi civilians.
At the time of writing, the Moroccan security forces are still putting under siege and house arrest a group of Sahrawi human rights activists belonging to the Sahrawi Body Against the Moroccan Occupation that was established recently in El Aaiún in occupied Western Sahara. The members of the Sahrawi human rights body and their families are also being subjected to all sorts of physical and psychological violence, mainly for having established a body whose objective is to peacefully resist the Moroccan illegal occupation and defend the basic human rights of the Sahrawi people including their inalienable right to self-determination and independence.
The Frente POLISARIO condemns strongly this new wave of repressive and terrorising actions carried out by the Moroccan occupying authorities in occupied Western Sahara where Sahrawi civilians, , especially human rights activists, are constantly subjected to arbitrary arrest, torture, illegal detention, sham trials, extrajudicial killings, and forced disappearance. The Frente POLISARIO calls urgently on the Security Council to hold the Moroccan occupying state responsible for its continued human rights violations in occupied Western Sahara, which are contrary to the letter and spirit of the peace plan and represent a blatant violation of the ceasefire agreement which requires the Moroccan occupying state to desist from all acts of violence and intimidation (S/21360, para. 14).
The Moroccan occupying authorities have also unleashed a frantic and chauvinistic smear campaign against the Sahrawi human rights activists, and they are preparing to take so-called “legal measures” against the members of the Sahrawi Body Against the Moroccan Occupation. The United Nations does not recognise any sovereignty of the Moroccan occupying state over the Territories of Western Sahara that it has been occupying illegally since 31 October 1975. Any “legal measures” or any other kind of actions to be taken by the
Moroccan occupying authorities against Sahrawi human rights activists are therefore null and void because the Moroccan occupying state does not have any administrative or legal jurisdiction over occupied Western Sahara.
The situation described in paragraphs 68-69 of the report of the Secretary-General (S/2020/938) of 23 September 2020 is just a fraction of the gross human rights violations that are being perpetrated by the Moroccan security forces in occupied Western Sahara away from international scrutiny. The Moroccan occupying authorities continue to impose a strict media blackout and a military blockade on occupied Western Sahara where even the United Nations bodies, such as OHCHR, are still denied access to the Territory, which has resulted in substantial gaps in human rights monitoring in occupied Western Sahara as outlined by the Secretary-General report (S/2020/938, para. 68).
The Moroccan occupying state would not have persisted, with impunity, in its illegal occupation of parts of Western Sahara and its human rights violations without the support and patronage of some parties that also bear responsibility for the consequences to which the reckless actions of the occupying state may lead. The Security Council is therefore called upon to use all means at its disposal in line with the UN Charter to compel the Moroccan occupying state to desist from its destabilising actions that are fuelling more tension on the ground and endangering the stability of the whole region.
I would be most grateful if you would bring the present letter to the attention of the Members of the Security Council.

Ante todo, quisiera expresar las sinceras felicitaciones del Frente POLISARIO por haber asumido la Presidencia del Consejo de Seguridad durante este mes.
Es con gran sentido de urgencia y profunda preocupación que les escribo, siguiendo instrucciones de mis autoridades, para llamar su atención y la de los miembros del Consejo de Seguridad sobre la alarmante situación en los Territorios del Sáhara Occidental bajo la ocupación ilegal de Marruecos donde las autoridades de ocupación marroquíes están intensificando sus acciones represivas y aterrorizantes contra los civiles saharauis.
En el momento de redactar este informe, las fuerzas de seguridad marroquíes siguen sitiando y en arresto domiciliario a un grupo de activistas de derechos humanos saharauis pertenecientes al Órgano Saharaui Contra la Ocupación Marroquí que se estableció recientemente en El Aaiún en el Sáhara Occidental ocupado. Los miembros del organismo saharaui de derechos humanos y sus familias también están siendo sometidos a todo tipo de violencia física y psicológica, principalmente por haber establecido un organismo cuyo objetivo es resistir pacíficamente la ocupación ilegal marroquí y defender los derechos humanos básicos del pueblo saharaui incluido su derecho inalienable a la libre determinación y la independencia.
El Frente POLISARIO condena enérgicamente esta nueva ola de acciones represivas y aterrorizantes llevadas a cabo por las autoridades de ocupación marroquíes en el Sáhara Occidental ocupado donde los civiles saharauis, especialmente los activistas de derechos humanos, son constantemente sometidos a arrestos arbitrarios, torturas, detenciones ilegales, juicios simulados, asesinatos y desapariciones forzadas. El Frente POLISARIO hace un llamamiento urgente al Consejo de Seguridad para que responsabilice al Estado ocupante marroquí de sus continuas violaciones de derechos humanos en el Sáhara Occidental ocupado, que son contrarias a la letra y el espíritu del plan de paz y representan una flagrante violación del acuerdo de alto el fuego que exige que el estado ocupante marroquí desista de todos los actos de violencia e intimidación (S / 21360, párr. 14).
Las autoridades de ocupación marroquíes también han desatado una campaña de desprestigio frenética y chovinista contra los activistas de derechos humanos saharauis, y se están preparando para tomar las llamadas “medidas legales” contra los miembros del Órgano saharaui contra la ocupación marroquí. Las Naciones Unidas no reconocen ninguna soberanía del Estado ocupante marroquí sobre los Territorios del Sáhara Occidental que ha estado ocupando ilegalmente desde el 31 de octubre de 1975. Por lo tanto, cualquier “medida legal” o cualquier otro tipo de acción que deban tomar las autoridades de ocupación marroquíes contra los activistas de derechos humanos saharauis son nulos y sin valor porque el estado ocupante marroquí no tiene ninguna jurisdicción administrativa o legal sobre el Sáhara Occidental ocupado.
La situación descrita en los párrafos 68 a 69 del informe del Secretario General (S / 2020/938) de 23 de septiembre de 2020 es solo una fracción de las graves violaciones de derechos humanos que están perpetrando las fuerzas de seguridad marroquíes en el Sáhara Occidental ocupado lejos del escrutinio internacional. Las autoridades de ocupación marroquíes continúan imponiendo un estricto bloqueo de los medios de comunicación y un bloqueo militar en el Sáhara Occidental ocupado, donde incluso a los órganos de las Naciones Unidas, como el ACNUDH, todavía se les niega el acceso al Territorio, lo que ha dado lugar a importantes lagunas en la supervisión de los derechos humanos en los territorios ocupados. Sáhara Occidental, como se describe en el informe del Secretario General (S / 2020/938, párr. 68).
El estado ocupante marroquí no habría persistido, impunemente, en su ocupación ilegal de partes del Sáhara Occidental y sus violaciones de derechos humanos sin el apoyo y patrocinio de algunas partes que también son responsables de las consecuencias a las que han afectado las acciones imprudentes del estado ocupante. Por tanto, se pide al Consejo de Seguridad que utilice todos los medios a su alcance, de conformidad con la Carta de la ONU, para obligar al Estado ocupante marroquí a desistir de sus acciones desestabilizadoras que están alimentando más tensión sobre el terreno y poniendo en peligro la estabilidad de toda la región.
Le agradecería mucho que señalara la presente carta a la atención de los miembros del Consejo de Seguridad.
